My concern is that the "I think you were texting" ruse could be used to initiate a search at will. LEO is known to stop and question guys who have been observed leaving providers' locations. This would seem to have the potential to give them more leverage.

Once a tool is approved for one purpose, it will likely be used for others.

Even if it does, I doubt content of the text will be able to be accessed. If the intent is to identify texting when driving, it does not matter if it is your mom or your provider- it would be illegal- the act itself of texting. A breathalyzer is different. If you refuse it, you cannot be charged with DUI for that reason. They can suspend your DL, but that is because the DL is a privilege and not a right and every time we sign for our new DL- we "consent" to this test when there is probably cause. Maybe this will be the approach, but texting has been recognized as a private right much different than the privilege of driving. Just my two cents.
