Say you pick up this girl, and she turns out to be only 17, and you get pulled over.... are you headed upstate for 20 years?

I've always wondered about this, and about what happens if that girl who tells you she's 18, is only 17.

if you litteraly "just picked her up" you are only giving her a ride, even if picking up a hitchhiker is illegal at that location (and assuming you have no warrants) (or a s.o.a.p. type restrictions) you should be fine; but expect a lecture at a minimum. there is as of yet no bureau of pre-crime. now if she has a record for prostitution, and you are in an area "known" for prostitution; especially a soap zone, and you say something stupid to the cops, or she accueses you of soliciting her...

well, that's going to require a good lawyer, at a minimum. still as long as you have not exchanged money, commited a sexual act, or solicited for one; you should be able to avoid jail.

check the 22 rules for mongering, or posts made by me (mostly on the seattle or tacoma boards), or by other mongers on what to do if stopped by leo. what you should do is the same, but the consequences are significantly more nasty!

basically "you have the right to remain silent" and you should! be polite, answer the questions you must truthfully! i.e. "what is your name, is this your car, do you have a licence, resgistration, proof of insurance" you should always have those things when mongering, and never bring an ilegal weapon, ilegal drugs, an open container of alcohol, etc. if the answer will incriminate you don't answer. you might ask if you are under arrest, if the answer is no, then ask to leave. if the answer is yes then remain silent until you speak to an attorney! (again you should give your name if asked, if you have already given them your driver's licence, then if asked you might as well give them your address, since they have it, be polite, and insist on your right to remain silent until you have spoken to your attorney!

a great danger in the senario you posted is that she has ilegal drugs on her. again follow the rules, remain silent! i suppose you could say "those aren't my drugs!" leo will expect it, they won't believe you (or at least they will pretend not to); it doesn't really matter the drugs were found in your car! get an attorney!

Having sex with a minor is just plain stupid and gives our hobby a bad name. So if you suspect she may be then ask her date of birth or DL.

If the cops stop with you with a minor there is not much to worry about unless they catch you in the act. This assumes that you asked if she was of legal age. Now if you unknowingly had sex with a minor and are caught they will charge you with committing a lewd act in public place at a minimum. There is some gray area in the statutory rape charge. It is not a crime to have sex with a minor if you did not know she was and asked her if she was of legal age. The problem here is that proving that might difficult since you have to have her testimony to prove this. Chances are she will have left town.

There is a small chance the SW may rat you out and accuse you of soliciting her, but chances are little if any. After all a SW does not want another conviction and go to jail. Now I did hear of one case some stupid guy was driving a stolen car and the SW ratted him out. But this is because the cop lied to the SW and told her that she would be a accessory if she did not admit solicitation.

while leo generally preffers to arrest all of the persons involved in (what they suspect to be) a crime, their emotions and motivations may color how hard they will work to nab some suspect(s) rather than others. most leo's only have so much time and effort they can afford to devote to any suspected crime. if, by talking you give them evidence of a crime, they will be willing to take more time and effort to make it stick! remain polite, because if they are human too, if they think you have "an attitude" they may be willing to work harder to bust you. it won't hurt, and may help to call them sir; no matter how you might feel about leo, its better than spending time in jail!

"h" is being far too complacent with a faith that a prostitute will not "rat" you out to leo. too many providers are stupid, or panic in stress situations. don't depend on them! if you are with a regular provider, and you can be fairly sure that she is smart enough to avoid going to jail (knowing incrimination you also incriminates her), then you are probably ok. as to asking her her birthday, to produce a driver's license, etc., "she's not going to lie about her age?!?" have you ever heard of fake id?

in the end it is up to the john to be aware of potential dangers. including the possability that a prostitute is ****! if you demand a provider show you id, question her strongly about her age, etc., you are more likely to get her to think you are leo. she'll bail, or likely give you worse service, if you get any at all. she is also likely to spread the rumor to other providers that you are leo. do you even know what to look for when checking id? there are plenty of decent fakes easily available; or stolen id, etc.

I agree that you cannot be 100% certain that a SW won't rat you out. But I have only heard of one case where this happened.

There a lots guys on this forum who ask a potential minor if they have ID and there is usually not a big problem or the girl does not have one on her. If it were a fake ID then it works in you are stopped it works in your favor it would show that you tried to prove she was a adult. In the end remaining silent is always the best course of action if you are stopped.
