Probably a worst case scenario is LE obtains the person's phone, pulls off all the text messages, calls the number as well to confirm, has the ad to which the person responded, has an audio / video recording of everything and the person even confesses to setting up a sex for cash arrangement. The fewer of those things that are present, the better off for the accused. In the hypothetical provided by RB, LE could still have enough evidence for an arrest; they'd still have the text exchange on their phone, the ad the person responded to and the fact that the person showed up at the exact location, date and time as discussed. If they did an inventory search of the car the person arrived in, they'd likely locate the phone. Then, even without the text messages, the LE could call the phone to confirm that it's the phone used for the text exchanges setting up the meeting. RB's scenario probably provides more help in defending the charge in court than it does as to avoiding the arrest in the first place. Unfortunately, if cops THINK you're doing something illegal, you're getting arrested, simple as that.
