Great advice. I would really have been interested in seeing exactly what the police officer said. Just as the mic was passed on to him, the video ended. It would have been especially interesting if he in fact agreed with the speaker.
You have to be appraised of your Miranda rights and given a chance to waive them prior to any statement you make can be used against you.
The trick is voluntarily saying something effectively waives your right to remain silent. Cops don't have to record your statement either and any statement you make that is considered voluntary will be admitted as a confession.
Cops even will try to use silence as a means to show consciousness of guilt as well to articulate probable cause.
But as a general rule, don't say anything to anyone. Make it clear that you are not waiving any right to remain silent. You never HAVE to say anything to anyone without legal counsel present.

That is not quite accurate.
Before your Miranda rights kick in you have to be in police custody. And what constitutes "custody" is a tricky question that is often the subject of hearings etc. If you are not in custody at the time of the statement, anything you say can be admitted even without a Miranda warning.

That last sentence is not quite accurate. A suspect's silence is not admissible because everyone has a constitutional right to remain silent in the face of police questioning and if that silence could be used against you then that right would be meaningless.

One possible approach is to simply say: "I would like to speak with an attorney before speaking with you, sir...." And then be ready to fend off the counter statements from LEO, "Why do you want to go and complicate things and get a lawyer when all I want to know is ...." Technically, the interview is supposed to end immediately upon your request for a lawyer, but we all know that LEO does not abide technicalities all that well.

Post 552: The first and seventh pic is the same girl. She's a skinny little spinner East of the river. I wouldn't repeat. Not very sociable and everything was a chore. Pics 2 and 10: This was a girl that advertised in the Advocate a while back (Hot horny housewives). she was cool; pretty nice body, fun attitude. Had her girlfriend with her, but wouldn't join us for free.
