It's what you say and admit to after your arrest. All it would take for a charge to stick is for the monger to admit to something when the cops show up. I have been doing this for 35+ years, pulled over, questioned, handcuffed, you name it, but never arrested or brought in. One thing is clear, there is a big difference between arrest and conviction. To get arrested, all the police need is probable cause. So if you be a real jerk, they could get pissed off and arrest you for suspicion. Get your mugshot in the paper, have to get bailed out, yada yada. So you should be polite and stick to a story that doesn't give them probable cause. Talking to a girl isn't probable cause. Giving a girl a ride isn't probable cause. Even giving her money (for food, whatever) doesn't give them probable cause.
There is nothing about leaving a motel, no matter how seedy or who is in the room, that gives them probable cause for an arrest. If the room you come out of is a known drug trap, then they already have probable cause to search you. That is a totally different situation. Hooker living in the room? Doesn't mean you paid for anything. Being in a room with a hooker isn't probable cause.
If the member was busted, he incriminated himself, plain and simple. Don't be dumb, always have a story and stick to it. Shit, the time I was pulled over, handcuffed and grilled for an hour, it was in Chicago in the middle of the night. Those fuckers are brutal. They held my car until K9 came. Stayed a couple of night over by Stark /205, figured I could find something nearby to make it interesting. First night out it was pretty minimal. Some very messed up blonde at the MAX station, but just as I went to investigate to see if it was worth talking to, the maintenance guys showed up and spent like 20 minutes combing the platform and upper parts for anything amiss, and I couldn't initiate anything in peace.
