Yes, Florida is a two-party consent state, but there is an exemption for cases where there is no expectation of privacy (for example, in public). You don't need an attorney at that time, just don't answer any questions until there is one present, once you ask for an attorney they are done, no more questions, now it's up to them to prove the crime or let you go or arrest you, if you shut up the crime is very hard to prove. If you are arrested you will have plenty of time to get an attorney.

What I meant to say is that they will try to get you to write a statement telling the truth and incriminating the girl and yourself and they will lie to you and tell you if you do, that they will let you go. They are allowed to lie to you, the Supreme Court has ruled on this. Make no statements, write no words "telling your side of the story", sign no papers what so ever. If they arrest you the burden of proof is on them to prove your crime, the cops gather the evidence and turn it over to the prosecutors who determine if the evidence is strong enough to go forward with an information (the formal charges) or file a no information (laymen call this dropped charges) , this happens after your arrest.

They are allowed to detain you for a reasonable amount of time while they "investigate" which means while they try and get you and / or the girl to incriminate yourselves. After a reasonable amount of time (Lets say 45 min, you may ask if you're going to be arrested and if not, are you free to go.) Depending on how much time they want to take to break you down and what else is happening at that time on the trail or elsewhere this time varies greatly. This is all assuming that you have no warrants, no illegal firearms, no drugs in your possession and have given them no reasonable cause to search your vehicle. They will ask you if you have any needles in your pockets or in your possession and will 'pat you down" for weapons under the guise of officer safety while they are investigating. I had the misfortune 1 time to have direct contact with LEO with a DWI when I was 21 and I would have saved myself a lot of headaches just by asking for a lawyer right away. It was a weird deal not worth going into all the details, but I will tell that is great advice. Ask for an attorney and shut up. Trust me they will blink first.

They will say you fit some description, you are coming from the direction of a disturbance, or that their dog alerted. Any of these reasons will give them the right to question you or search your person or car. Now if it goes to court who will the judge believe; you or the cop.

There was a study done on drug dogs being wrong about 60% of the time. What the study found was the dog wasn't wrong it was that the cops lied about the dogs alerting. If the dogs alert the cops have probable cause to search you or your vehicle. So cops would lie to the person so they could search. It was interesting that the dogs were wrong more often with minority suspects; some thought the dogs were racial profiling. However, it was discovered the cops would use that lie to search minorities more often. And then they wouldn't find any drugs so the researchers thought the dogs were wrong. But it was found that it was the cops that were lying about the alert reponse. And when it gets to court the judge almost always takes the cops word over the suspect.

Well, I just happened to leave early 4am) for the airport so thought I would try to relieve a little pressure before my flight. Started the cruise in Kissimmee, but saw nothing before the Turnpike. Once north of there, saw three BMW, one spinner two a little chunky together, but not my style so didn't slow down. Last night was the first nite I was like, I'm going to do this.
