Also, you are going to have to fill out a waiver (agreeing not to sue state, police, or officer) if the Nolle Prosequi was entered within 3 years, or wait 3 years (statute of limitations). The clerk's office should give you a packet with all of the forms that you need, and you will be waisting your $ if you hire a lawyer. Also, just FYI, the clerk's office cannot refuse to accept anything for filing (as long as its in proper form [signed, your phone number, address, and certificate of service, etc. ] and you paid the fee) , and the clerk's office cannot adjudicate the merits of a petition for writ of expungement. If they give you a hard time at the clerk's office, ask to speak to a supervisor.

Feel free to pm me on this issue if you have any questions. You can probably handle an expungement on your own. There is a good brochure available on the maryland judiciary web site on this issue. Assuming that your case was nol prossed (what is officially referred to as nolle prosequi in the brochure) , you have to either (1) wait three years from when the case was disposed of (which would be November 2013 based on your posting) or (2) you can do it now but you have to sign a release that is contained in the expungement form in which you release any claims that you may have against the police department, etc. The idea with number 2 is that big brother government does not want you to have your records expunged and then you file a lawsuit within the three year statute of limitations and they cannot defend the case properly because they do not have the records. So if you do not plan on suing the police department for false arrest, etc, then you are probably ok signing the waiver and seeking the expungement now. But if you are planning on pursuing a claim (or are not sure if you are going to) , then you should wait the three years. Expungements are automatically granted, assuming that you meet the criteria for eligibility.

You have to wait 3 years or waive claims against the State, etc.

She told me you can't ever get if off once they have it on file. I think she was just feeling sorry for herself. She was telling me how she used to work in dispatch making $25 dollars an hour 10 hours a day at one tine in her life. She's a Very nice girl but I wanted another opinion. Stet is 3 years but the brochure that I mentioned in my earlier post also says that "you may also petition the court for expungement at any time on a showing of good cause." So depending on your situation. Say for example you are trying to find a job, etc, then maybe you might get lucky and convince a judge to expunge the records on good cause shown. Otherwise, you have to wait 3 years.

Poor lighting-good intent.

I just want to cover a couple of items before we get to todays adventure.

I was out of town for a few days and upon my return I found my inbox with 53 waiting new messages. Work has been very busy and I am trying to get responses out as quickly as I can.

For those of you who have managed to get a number for Linny, and have gotten a chance to meet with her, she did contact me today and does have a NEW number. PM me for the updated info.

My few days away and returning to a mountain of work, my hunting had to be put on the back burner. This decision resulted in a continual array of text messages of lovely ladies wnating to be visited. Can you tell us how she approached the car? Did you talk through the window or did she just hop in? Cop check? Did you offer money up front? Etc. The more details the better. I was driving down wilkins ave one day and passed by the circle. I saw I WSW but passed her up and kept on driving. Well gentleman, I was finally caught by a LEO. We had just gotten to the spot and negotiated the fee. We were seconds from starting, and I saw a car stop in the distance. No sign of her so I took De Soto to Washington Blvd. And cruised down Patapsco, Pennington, and Fairhaven. It was dead in that area so I decided to try to find Nicole a 2nd time. Took Patapsco back to Washington Blvd. Back down De Soto, and then back around the circle. Finally decided to make a right on Pulaski and caught Nicole walking down the street. Last time there about a month ago, tried getting together with Kiara with no success, finally picked someone up, can't remember her name, very forgettable expeirience. I did ask her if she knew Liz and she told me yes and she has been locked up for a while, makes sense being the long absence. I hope this is her, sounds like it since she did say she was from NC.
