Sadly, the Latina and the John that I'm assuming got popped together, based on the arrest log from IRPD, the two of them have different court dates. Today was the Latina's turn.

She waived the reading of the "Indicated Sentence" and went straight for the not-guilty plea. The reading of the Indicated Sentence as I understand it, is simply a reading of the sentence that the Judge is likely to hand out based on what he knows of the case as of this moment. She kind of blew it, since she might have been able to get this behind her in a very simple manner.

So, October there will be another hearing, after she visits the Public Defenders office to get representation.

She was late, and didn't get her papers on the 1st calling for all defendants to get their papers, so that means she had to wait until the 1st recess to get her papers so she could appear. Made for a bit of a longer wait for myself.

The way this court room works, Judge London, he naturally calls most of the cases that are attorney represented 1st. Then he works through the DUI cases, then onto driving on suspended license, and then to other misdemeanors, like theft, riding a bicycle while intoxicated, seriously there was one of those.

The theme I saw in the misdemeanors, the defendants as a 1st time offense were offered 1 year informal probation, along with all of the mandatory penalties, like the LE agency arresting fee, which is in the 200-350 range depending on the city. There are court fees, and maybe some others. Pay the fees, during probation break no laws and before the 1 year runs out, file a petition with the court to remove the conviction and have the case dismissed. This was all done by the Judge to help expedite things. The ADA was present in the room, but didn't offer much input aside to comment on those where the Judge didn't see the prior convictions.

Showed up for Court today. Judge London was not in court, but had a substitute Judge. Remember how things went when the substitute teacher was sitting for the regular teacher in elementary school? Well, kind of same thing.

The john in the case was represented by an attorney, just didn't show up on the court schedule as of last night. Didn't catch the name either. There was quite a bit of activity on the behalf of the the's office, they were constantly pulling people aside and making deals with those without an attorney present. So, it was quite challenging to hear what happened, and in fact didn't really hear all of it.

The important thing, which I didn't hear was that the attorney asked for a continuance on the arraignment, but I did hear, on the grounds of "new information". It was granted, looks like according to OCcourts. Org it will be on 10/25/12. I suspect the "new information" is that the lady plead not-guilty, although no idea how that impacts the other participant in a prosecution setting. Seems obvious, but sometimes the law doesn't always follow the obvious.

The pre-trial date for the lady involved is 10/12/12.

This court room appears to move a high volume of cases. To do so, things are simplified to the point where everyone is treated the same. The most prominent charge, ie the one that will carry the largest sentence will be the one that determines the case. In nearly all cases, the other minor charges were dismissed by the Judge, with agreement of the the.

Should you get popped for participating in this hobby, I'd recommend you sit in the court room, days / weeks in advance of your case, in which you are required to appear. Although, you are not likely to see your exact kind of case, you will see other offenses, petty theft, DUI, public intoxication, etc. What you will see is how the Judge likes to handle his cases. I suspect the other Judges that hear similiar cases handle their cases in a similar manner as Judge London. In the end, you can make the best informed decision for yourself.

This should be on reality TV. Also, your advice about attending well in advance at the court you might have been summoned to appear in is good.

Unfortunately, for many of us, just the summons would do substantial damage, which is why some cop did it, even though he knew it would probably never go anywhere.
