Giving cash or sex to LEO in order for them to look the other way. The ploy of putting your cash in an envelope and then lay it on the dresser and then she looks inside it and does the deed does not help if she is LEO or if you are LEO in NY or any other state. That is still clearly an exchange of money for sex! Even worse if she looked inside it before starting the sex act!! It is obvious to a court and a jury that there was an exchange of money for sex, hence the parties would be guilty as charged.
Furthermore, it need not be cash, if a monger hand over a gift card or some candy and gets sex in return, guess what? That is an exchange of value for sex and the parties are all guilty!
If a monger pays a provider's rent and get sex for that, then guess what? Yes giving value for sex and a court would find them guilty.
My favorite is providers saying the donation is for companionship, any sex would be consulting not bought. That would not be enough to prevent her from being arrested if the guy was LEO, and it sure would be obvious that more than companionship was paid for, so the court would find her guilty.
Best way for your safety and a provider safety from arrest is to give the money after the deed and to not talk about money or amount before doing the deed. Then it can be argued, although it is questionable what a judge would say, that the money was given not for sex but to help the provider out, that they were friends and after sex the monger wanted to make sure she had money for room rent etc because he cared about her well being.
No way one can hand over anything of value before the deed and then avoid arrest if she is LEO, or vice-versa.
