I think it would appropriate to say Leo cannot use her information in court. I would wager a bet that Berry's gang tries to get information from the ladies to use to harass may-be mongers. Suppose they get a provider to say she was picked up by a guy driving a red Dodge pickup. If they see a red Dodge pickup with only a guy in it making a turn around or cruising, I bet they will follow that vehicle waiting for a scoop. In the case of the question you were answering, since it was months between the time the guy saw her and when she was arrested, I doubt she would have any information about him.

It's right that they might use the information in your scenario to hassle a monger, but that is a long way from using the information in court.

As Orlando J said, using it in court would require a Judge to admit the information into a case, which would be unlikely since it would be hearsay.

Using the information on the street to harass a monger is entirely different, in which case, as Orlando J said, admit to nothing. Without definite proof, the person in your scenario might be stopped and questioned (most probably in violation of his Rights) but unless he admitted to being the gent who picked her up, they would have no cause to arrest him for monger-related activities.

As I understood from the question that it's the case of an escort being arrested.
From experience during many years worse I used my personal cell-phone to do all my calls. I have never had problems. I had calls from providers, pimps and who knows offering me. I met girls that are not advertising. Just be careful what to say on the phone.

Now read these scenarios and the bolded italic portions that I added:

So let's say you just picked her up; she hops in, does a Jimmy check and the two off you start talking half-and-half, ben - jackson and abe...and then the cop take you down. I'd be real worried about then 'cause she's not going to attempt to lie her way out of it to save your ass. You're both probably going for a ride. If she's lucky with minimum charges if she's not holding any dope. If you're lucky it will be your 1st offense - it still will hurt your wallet.

LESSON 2: THE COP ISN'T YOUR FRIEND Don't give him (or her) too much information. If your friend hasn't already admitted to "solicitation" or your "offer to" then all the officers can hope for is for you to ADMIT YOUR GUILT.
[b][i] that's when the officer would start pushing you. The officer will tell you "you are lying to me" "you are challenging my intelligence" "tell me the truth so I can help you"
Here are some more lies they may tell you:

* "You're not a suspect -just help us understand what happened here and then you can go."

* "If you don't answer my questions, I'll have no choice but to arrest you. Do you want to go to jail?"

* "If you don't answer my questions, I'm going to charge you with resisting an officer."

* "All of your friends have cooperated, and we let them go home. You're the only one left."

this and that "now that you did not tell me the truth I am placing you under arrest" [/i][/b]

If your friend has already "implicated" you, the officers are probably trying to get you to implicate yourself. KEEP YOUR MOUTH SHUT! DON'T ADMIT ANYTHING! EVER!!!
Even though she's a known prostitute her accusation alone might get you arrested - it might not get you charged. You might be released without charges at your arraignment. If both of you admit your involvement you are both in trouble and will probably be charged.

I agree completely with your entire post. I once was pulled over and the officer tried to be my "friend, " asking me over and over why I was driving up and down the street. "I'm just looking for a 7-11" was my story, and I stuck to it, no matter how much he tried to get me to admit otherwise. It's unnerving to be asked the same question over and over, and le knows this. And so they will ask you the same question over and over, and use the other psychs you mentioned. Take me to jail and I still wouldn't admit to anything. This is the best attitude to have in these situations. Admitting anything means it's game over and you lose.

Another thing: when cruising, I always have a story in my head for why I'm in the area. That is, a good reason that I came from here, where I'm headed to, and for what reason. "Looking for a restaurant" is a good choice and I generally use that. "Just looking at the girls officer, but I'd never pick one up" is NOT ever the thing to say! I once got pulled over in North Vegas and the cop grilled me as to why I was in the area. "I was looking at the Casinos in this area. " That worked, but he said he didn't believe me. Of course le is going to express derision at anyone's story. Let him stand there all night and do so if he wants, but rest assured he'll be moving on soon enough, and so will you if you play your cards right.

I've also experienced le lying, as one time in Berkeley I happened to just look at a SW, was pulled over seconds later, and the officers said the SW admitted that I had propped her. Totally untrue, and in fact impossible. A real sucker gambit. Le will lie and in the same breath call you dishonest.

Always courteously play the victim if there's no strong evidence against you.

Sometimes I've thrown a cop a bone to let him understand that understand him, and respect his authority, but in a way that doesn't implicate me even one bit. I say something like this: "Look officer, I don't want any trouble. If you want me to leave this area, I will. " This is a good way to play the victim. By all means, let the officer know in an unaggressive way that you are not flouting his authority. At the same time, let him know that if he doesn't have evidence and you don't admit wrongdoing (including any kind of intent) then he's flirting with charges of harrassment. "Look, I don't want any trouble. If you want me to leave this area, I will" is an artful way to do both.

Once I was pulled over in a very Hispanic neighborhood by a Hispanic cop. I am not Hispanic. As he came up to the window and before he said a word, I said to him, it is obvious that you pulled me over because I am white and not Hispanic. He was so taken aback by my allegation, that he just mumbled something and let me go. Driving While White!

If you are stopped, take a deep breath and just remember one fact. You really are a lot smarter than even the smartest LE, because they is really dumb.

I was not offering advice. To pull something like what I did off you have to be smarter than LE. Obviously, some members of this forum do not qualify.

For the benefit of members who may not have thought of this, 7 Eleven sells a decent Motorola phone for $9.99. Pay cash for it and walk over to the pay phone and activate it. Now you have secure communications. They come with some minutes on them but I always get a 60 minutes air card also. Then you are good for about three months. Use it, turn it off, throw it in a dawer until you need it again or just throw it away and get another one.

It is cheap insurance. If someone threatens to post your phone number on the internet or give it to the cops, who cares. If anyone wonders why you have a extra phone, it's a backup to your main phone for emergencies.
