By that standard they could say the ladies walking down the street are all soliciting, and LE can have a hard time doing that. Part of LE is to intimidate would-be criminals. They might even cross a line and arrest you without cause, but at that point they are in the wrong and could do that at anytime.
I'm not a lawyer. But I do like to discuss these matters with other folks who may have more insight than myself.
