From what my lawyer told me this is how that works.

You can pay extra to the attorney to file the paperwork to have your record expunged, BUT that does not mean the judge will grant the expungment, so it is a crap shoot.

As I have known others who have, unfortunately, experienced the same thing. You are right, it does cost extra money- why? Because if the prosecutors (usually not the judges) oppose the action to seal the record, it will then or might take several motions offered before the court to get a record sealed (these motions are what's expensive, BTW). What makes it hard to seal is if you have been in trouble with the law several or a few times before. If it is your 1st offense, the prosecutor might not stand in the way.

It also depends on the relationship your attorney has with the judge and the prosecutors. If its a bad one, might be bad for you. But if your lawyer has a good relationship, it will make your life or circumstances easier. In the state of Florida, you cannot get a record expunge as there is no such law; however, you can get it sealed, if allowed, especially if you can prove to courts you were being stupid when you engaged in illicit activity. Due to the stupidity, your attorney can let them know your record is preventing you from becoming gainfully employed. No one in their right mind wants you to be dependent on the government when you don't have to be. So is it easier to sort of give you a break so you can find work, hell yes!

Anyway, as I said, you can get it sealed but you better make sure you have had no other issues that might cause them to look at you and say NOPE! And my understanding is that it is hard to get a job with this shit on your record. The best thing to do is stop doing this shit so you can decrease your chances of ever having to deal with this type of issue but if you feel so inclined to continue, you had better get well versed on how not to get yourself jammed up- its not worth it when you look at the big and little pix isn't it!
