Look at post 2309, it quotes the "compensation part" from the statute. However, all they have to do is to get the informant to say she agreed to a price before hand. If they have her web site, which they probably do, that would qualify as an "admission" under the Tennessee Rules of Evidence.

All I know is that when I left the police department after asking them if the nude massage I do could get me into trouble he said it could'nt and that I could olny get into trouble for and to having a business license. I am no lawyer and don't know personally I am simply going by what a sheriff that brought out all the law books and sat down and talked to me and read them told me. Bottom line is. I'll be going to court at the end of this month and I will post exactly what is legal and not when I get back on here to post about the outcome. Please also remember that when the guy tried to give me the money I told him not to worry about it and as far as that goes if I was doing the massage for free for him reguardless if my website has a rate or not I will be seeing soon if that still matters.

I guess the long arm of the law finally caught up to her because she is now a guest of the county as of this morning. No details yet so I don't know whether they picked her up just for the warrants or if she arrested for another infraction.

Neysa, in your first post you said you were arrested for prostitution. If the guy was an informant, the Nashville LEO was trying to set you up. They are not going to go to that much trouble to bust you for only giving massages without out a license since it is a misdemeanor one step up from a speeding ticket. They want you for prostitution. I don't care what the sheriff told you, he is not a lawyer, you can be charged under at least two prostitution statutes. You need to get a Nashville lawyer and find out exactly what statutes you are charged under. You don't need to go into court thinking you are only charged with not having a license and then find out the hard way (no pun intended) you are charged with prostitution. Whether you call it a "happy ending" a "local massage" or a "hand job" it is all prostitution under Tennessee law, and that is what they want to get you for. Take my advise, don't go into court alone.

I just gotta tell a story that happened - we all know that even the losers get lucky sometimes - and man did I get lucky.

Had to take a 4-states across trip to a University town - and I posted some CL ads prior just feeling out the situation - as 'Generous Business Traveler'...

Anyway I had a few hits but 1 in particular was from just a regular gal who's husband recently divorced her ( she was 26 !! ) and she wasn't bad looking at all. After several howdy-do Emails and explanations of what I was doing in town and what I was looking for she said she 'may' meet me if she felt like it one of the nights I was there.

There were circumstances that didn't exactly make me 100% available except for 1 night - and I shot her an Email and told her I'd like to see her sometime after 8:00. Between dinner and yapping etc I didn't get into the room until 9:00 and figured I was screwed - but I shot off an Email to her anyway and said that I was about to hit the showers - and that I was tired and would be most likely lying down resting - and gave her my room number and told her if she felt like it just come on over.

I fired off the Email about 9:15 and at 9:45 there was a knockin on the door and I just about had a cardiac -

I was in my drawers and a T-shirt and opened up the door to a nice looking 26 yr old in a sun-dress and flip flops and she comes in - gives me a hug and a squeeze between the legs - I slipped off the dress from her shoulders and we were off to the races.

She was only concerned about getting pregnant so after the first nut we went totally natural after that - I'm talking about the ressurection and re-ressurection and re-ressurection - toys - and reverse cowgirl - and BBBJ after BBBJ after BBBJ and doggie from me with a toy in the front and a thumb riding her ass. Daum she was hot. We'd take a break and go out for a smoke and then come back for round 2,3,4.

She almost witnessed the second coming but at my age it just wasn't going to happen.

She stayed with me until just after Midnight - I'm 52 - she was 1/2 my age and was eager to be with me - I tried to slip her 2 bens and told her that I'd like for her to have it - to go ahead and treat herself to something nice but she wouldn't take it. Would not have a thing to do with it.

It's been a lonnnnnnnnng time since I had any fun like that.
Too long.
Kinda makes me want to take another trip.

I am charged with prostitution but first of all I told him no to the money so we will just have to see what they do with it. I already have public defender plus the attorney I used in my divorce and my custody battle so I'm good to go on that. I'm a first time offender and I never took the money so we will see how far they can take it. Plus as far as the HE goes. May have never been said. Going to take some proof don't yah think? Well as I have said before I'll keep the board updated as far as when I get the number called from and more info. I'm far from stupid about all this but its simply crazy they are out this bad to bust someone for a little nude massage with or without the HE! There are girls out ther robbing men and selling drugs and passaing around diseases. Think they should worry about them! I'm a quite person who does'nt bother anyone or cause any trouble and have never offered full service to anyone. For the love of god. Seriously?

I am on vacation and working from an iPAQ when everyone else is not around. I can not see very many lines at a time and typing is hell. So please accept my apology.

She really does need a lawyer. I know most people don't like to spend the money and Nashville PD knows this. If they are going to work in this buisness they need put money back in a reserve fund. It just like having trucks or rental property you are going to have expenses and you need to budget for them.

There's two factors here. The legal thing is, you seem to be laboring under the impression that a nude massage with HE isn't prostitution. Disabuse yourself of that notion. The HE constitutes "sexual contact" under TCA sec. 39-13-501(6), and that's enough (IMCLO) to bring you under the scope of TCA sec. 39-13-513 (the prostitution statute proper), should a jury decide that your service involves the agreement to provide the HE.

[Disclaimer: while I have the law degree and I've practiced for a while, I'm not licensed anywhere now, and specifically I'm not licensed in Tennessee; the above does not constitute legal advice and isn't to be construed as such.]

The practical matter is that it's a question for the jury if you go to trial, and the evidence is pretty much going to be your word against the informant. If your lawyer does his/her job correctly, you might have a chance. Not much of one, but there's a very small but non-zero probability you might win at trial.

Sincerely, good luck. Just keep in mind that the deck [i]is[/i] stacked against you, so don't persuade yourself that you're entitled to have this all go away just because you were giving away a freebie to get a regular customer later, and don't persuade yourself that you should get a free pass because a nude massage with HE isn't prostitution. The system doesn't work that way. Reality is what it is, it isn't what you want it to be.

BCG[/QUOTE]I can tell you that it works, but you have to put time into it. Maybe 2 times out of 30, which for me is maybe 7 times a year. CL takes alot of patience to sort out the crap. Adult Friend Finder used to be the place to look, but now it's turned commercial and scam as well. Best bet IMHO is swappernet and swinglifestyle.

Neysa, your fate is now sealed. You are going to be convicted of prostitution. However, you probably wont get any jail time, but the Nashville LEO will have another scalp to hang from their belt. Don't expect any help from the public defender. He has hundreds of cases and yours will be at the bottom. His job is to plead most people guilty and create enough of a record that the gulity plea will pass constitutional muster. He will spend no more than five minutes with you.

Neysa, Please spend a little money and get a lawyer. I know we are beating a dead horse here but there is a reason for it.
