I can't remember the exact year, but sometime in the mid 80's a guy in Gainesville was with his girl in a car doing what comes naturally when all of a sudden The Man approaches with weapon pulled and arrests them both for public exposure, lewd and lascivious behavior, and solicitation. Both pleaded not guilty and were subsequently convicted on all three charges. The guy's attorney filed an appeal based on privacy and 4th amendment issues. Ultimately it went all the way to the The Florida Supreme court who unanimously overturned the convictions and in their decision they considered the vehicle an extension of his home because he'd put a sunscreen in the front window and the rest of his windows were tinted, therefore he had a reasonable expectation of privacy. As far as a person walking up to you and photographing or taking video, you'd probably be able to go after them if they posted the images somewhere. But I doubt someone would risk an ass kicking and actually do this. I've known other PI's in the past who have been arrested for videotaping a subject through their residence windows, even though it was visible from a public vantage point. It's a very precarious situation. One last thing: Florida Statutes, Chapter 493 covers Private Investigation. In that chapter it clearly states that ANYONE, other than in house investigators (those that work for a company like a loss prevention officer in a retail store, investigator for human resources for back ground checks or investigators for lawyers, etc.) or journalists, must be licensed to conduct investigations. Go to the Florida Division of Licensing an look at the bi-annual newsletter. They list the violations and you'll see dozens and dozens of people who were fined as much as 10, 000 dollars for conducting unlicensed activities defined in the chapter.
