One charge in particular stood out to me. Is NOT against the law in Florida to get a massage w / o being draped! If a client requests that, then the therapist is not doing anything wrong, therefore can't be changed with that. Florida is a draping optional state.
I am a massage therapist and as such, you have to explain the draping process to your client. It's up to them if they want to use it or not. With that said, most chains, and therapists require draping as their own practice.
Here is the law regarding draping in just in case anyone ever gets caught uncovered on a table. Unless you're caught in the act of FS, they have nothing on you! I didn't include the first 4 because they don't pertain to the topic at hand.
Misconduct and Negligence in the Practice of Massage Therapy. The following acts shall constitute the failure to practice massage therapy with that level of care, skill, and treatment which is recognized by a reasonably prudent similar massage therapist as being acceptable under similar conditions and circumstances:
(5) Failure to appropriately drape a client. Appropriate draping of a client shall include draping of the buttocks and genitalia of all clients, and breasts of female clients, unless the client gives specific informed consent to be undraped.
