INDIANAPOLIS - IMPD Officer Courtney Harris was formally charged with five felony charges, but rape was not one of them.
"This is one officer out of several thousand who put their lives on the line every day to make sure we are safe. So it's certainly not a reflection of the brave men and women of law enforcement," said Marion Co. Prosecutor Carl Brizzi as he headed into court Wednesday morning.
The department is calling for Officer Harris' resignation. He's charged with:
1. sexual misconduct 2. criminal confinement 3. intimidation 4. official misconduct 5. obstruction of justice
The 27 year-old alleged victim says Officer Harris picked her up on east 10th Street, while she was carrying a crack pipe, with an outstanding warrant.
She says he drove her to a secluded area, raped her against the back of his squad car, then dropped her off on Tuxedo Street.
The one charge that isn't currently filed is rape, because prosecutors say they don't have the evidence to prove Officer Harris used force to have sex with her.
That's proof they'll need, because the alleged victim has a record of prostitution.
"Well, of course that's gonna, that will be a factor. Might not be the determining factor, but certainly as we weigh the evidence, weigh her statements, weigh her credibility that's something that we'll take into consideration," Brizzi said.
The other charges stem from the accusations that Officer Harris used his squad car to confine the woman, and that he threatened her to not report the incident.
Harris remains in custody, on $50,000 bond.
IMPD already served termination papers for Officer Harris. The case will go before the department's merit board. Harris is currently suspended without pay, and a trial date has been tentatively set for April.
IMPD Chief Michael Spears issued a statement about the accused officer, Courtney Harris:
"The incident involving Police Office Courtney Harris is inconsistent with the values and integrity of the officers who serve at the IMPD. Officer Harris's action tarnished the Department and broke the trust that the community has placed in the police department."
"Therefore, the department moved quickly to assist the Marion County Prosecutors office in the investigation and subsequent arrest of Officer Harris. Behavior that is inconsistent with the mission of the Department and the oath of office to which its members swear, will not be tolerated."
