[I]. . . the defendant named above on 04/07/2015 in Davidson County, did intentionally, knowingly, or recklessly engage in prostitution. The probable cause is as follows:

On the above listed date Det. England was working in an undercover capacity when he observed the defendant walking down Dickerson Rd. Det. England stopped in the parking lot of 1801 Dickerson which is the parking lot for Hard Times Bar and Grill. Det. England called out and asked the defendant if she needed a ride. The defendant came up and got into Det. England’s vehicle. Det. England asked the defendant how much it would cost for her company, to which the defendant stated “I know what the police ask when they are trying to pick up girls.” The defendant stated to Det. England that she was going to search his person and check his ID before they would speak about any kind of sexual acts. The defendant searched Det. England’s person and checked his ID as they drove around, then began to grope Det. England’s genitals as they drove down the street. Det. England again asked how much it would be for oral sex from the defendant to insure that he had enough money and the defendant stated “We will talk about it at my house.” Det. England gave me the take down signal and I took the defendant into custody. During the search of her purse I found two syringes, one glass crack pipe and one metal crack pipe. The defendant was explained her Miranda rights and she stated that she understood them. I asked the defendant if the drug para belonged to her and she stated that the drug para did belong to her. As I was booking the defendant it she stated to me that she did intended to make a prostitution deal with Det. England because she needed the money.[/I]

Approxametly 30 minutes after arresting the females hrs there was a knock on the wall from the room next door. We did a knock and talk and spoke to this suspect. I asked if he had anything on his person and he said "no". I did a cursory patdown of his pockets to make sure he didn't possess a weapon. He did not. I said lets go inside the room and talk and we did. On the desk in front of the bed there were two room keys. One was clearly marked xx6 and one marked xx8. There was also a pink bag on th counter that appeared to be from Victoria's Secret. I handcuffed the suspect and read him his Maranda rights. He stated that he understood. I then asked where the girls id's were and he motioned to the purse that was sitting on the bed beside him. I then asked where their luggage was and he motioned to the red piece of luggage on the desk as well as two pieces of luggage in the closet area behing the door. He confessed that both rooms were in his name and that he had driven them to Nashville in his car. He stated that one of the females, xxx, is his girlfriend and the other, xxxxxxxx is like his sister.[/I]

You would think he would have heard all the LEO or "extra traffic" around. Once he knocked on the wall, he was toast. Had he not opened his door, he may have bought himself time but they would have waited on him or forced themselves in eventually; no warrant needed. Without all the info, it's hard to tell what the whole thing is regarding the girls. Were they wiling participants or a form of trafficking? Later on I will share info on a case from a year ago, I just have to make sure not to violate any forum guidelines.

I can see the reason why they would do so but as the report says, LEO "will still be able to make surprise inspections by getting a warrant". I had seen an old report where LEO simply looked at the guest list and recognized a name, which gave him reason to inspect, because he was sure he would find something illegal going on. LEO has many ways to get what they want, which I am all for as long as it doesn't infringe on people's rights. Officer xxxxx asked xxxx if she had anything illegal and she stated she had a pipe in the air conditioner. Xxxx directed Officer xxxxx to the pipe's location and Officer xxxxx found a metal pipe that contained dark residue and chore-boy believed to be used to smoke crack cocaine. Xxxx gave Officer xxxx and Officer xxxxx consent to search the room. Officer xxxxx found a plastic bag in the night stand that contained several small white rocks that field tested positive for cocaine. Officer xxxxx also found some loose chore-boy behind the television. Xxxx didn't qualify for a citation.

But they do this a lot and have been doing it for a long time on Mboro. I would think that the records should be private but maybe not. The thing as well is the defendants allow the police to search and look around and they tell on themselves. Why did she even tell the officer she had a pipe in there.

Q: How can I tell if I am having a consensual encounter?

A: When asked to decide if an encounter was consensual, courts will examine whether a reasonable person would have felt free to leave. Courts will consider all of the surrounding circumstances in making that determination. However, because each situation is unique, the line between a consensual encounter and an investigative detention is not always obvious. The situation will determine whether your Fourth Amendment rights are involved.

Q: Must I reveal my personal information during a consensual encounter?

A: No. If an officer asks for your name, address, or date of birth, you are not required to provide it during a consensual encounter. However, if the police have "reasonable suspicion" that you are committing, have committed, or are a witness to a wide range of possible offenses, you may be found guilty of a separate criminal offense if you do not provide that information.

Because it is difficult to know whether an officer has the required "reasonable suspicion," you may want to provide your name, address, or date of birth if asked. However, you are not required to provide any other information. Also, if your age or date of birth is an element of an offense that you are suspected of having committed, such as underage drinking, you are not required to provide that information.
