Richard M. Jackson contends he acted in legitimate self-defense after he insulted one of the pimp's prostitutes. The deputy, who was suspended after the killing, armed himself after the prostitute complained to her pimp who returned with a 9mm pistol looking for payback, said his lawyer, Kenya Herring.

"They don't know he is an off-duty deputy," Herring said before testimony opened today in Superior Court."They think he is a John who got out of line."

Prosecutor Sheila Ross said the facts show that the deputy was the aggressor. Ross said the Jackson pulled his Glock 9mm pistol and tried to tear Savannah Roper's skirt off after he refused her demand for payment when they were parked behind an apartment complex near midnight on July 15, 2006.

When she managed to escape his pick-up, he fired a round at her as she fled to her pimp, Alan Griffin, who was in the courtyard of the apartment complex known for the sale of sex and drugs off Cleveland Avenue in Atlanta, Ross said.

Griffin grabbed his pistol and returned to confront Jackson who by that time was hiding behind a dumpster and ambushed the 22-year-old as he rounded the building corner, Ross said. Jackson then fled into the woods where police arrested him, she said.

"You may not agree with the way Alan Griffin lived his life, but your are certainly not going to agree with the way he died," Ross told jurors."No man is above the law, especially one who is sworn to enforce it."
