Probation is also called community control, you are under the probation officers control instead of being in a jail cell. I think if you check you will find that you in fact a P. O. Can enter your premises at any time if they suspect illegal activity, LEO has used this as a workaround the warrant when there is a sure bet on a house full of drugs. A person on probation for a drug offense will be tested at least monthly during their probation appointment, if not a drug offense you will be tested randomly. You also need to report any contact with a LEO.

As a matter of practicality from an overworked system many of things that could happen do not. Basically you show for an appointment and maybe have an interview and a drug test or nerther they may wave you off. Much depends on your behavior and the P. O. You are assigned. They will come to your house just to physically see you during the month as well.

Basically when you are on community control you will find it difficult to assert your constitutional rights because your P. O. Can call LEO and have you jailed for a violation. Community control is an alternative to jail.VS

For starters, you are right about one thing. It is generally a good idea not to talk to the police if you get caught in a tricky situation. But there have been some confirmed reports on this site that on a few occasions a few polite words got a monger and a provider off the hook. I know this as a fact as it happened to me.

Other then that, just about every other statement you made is asinine. You tell providers not to tell the police there address as it could lead to another charge. First off, the charge you are referring to regarding entering a premise involving criminal activity can be charged even if its not your house. Here's some information for you zippy, you do not have to be UNDER ARREST or READ your rights to ask for a lawyer. You can do that at any time. Further, the police are not required to read you your rights unless they are going to question you. If they are not going to ask you anything other then your name, address and date of birth, basic pedigree information, they do not have to read you your rights. Did your 3 legal eagle attorneys let you know about that? Yes that includes being arrested.

I will not even debate the absurd probation violation and jail terms with you, as its ludicrous.

If you are convicted of a crime there is a mathematical formula used to determine the guidelines for sentencing. For example, your formula may recommend 2 years in jail out of a possible 8 year sentence (the maximum for that specific crime). You get probation for say 2 years instead of jail time. If you violate your probation and found so by the court you get a BUMP in your sentencing formula and instead of 2 years it may become 3 or 4 years. If you frequently violate your probation, you get numerous BUMPS, and you could be sent to jail for the full 8 years even though the original sentence would have been 2 years. Thats how it works zippy. In Florida violation of probation is not a criminal offense, but it does enhance the original sentence. If the maximum sentence you can be given for a crime you are convicted of is 6 months and you violate your probation a million times the maximum you can be sent to jail for is 6 months.

Now go tell your uncles, friends, cousins, brothers, landscaper, who thinks he is a lawyer and knows law to STFU, and I also would demand to see the law degree and bar card of your 3 retained lawyers.

It is with regret that I see that Passun8 and Clayfornow have left the forum. I think they were both good contributors and decent guys. I wish both of them best of luck in their future.

I do not know the circumstances of their departure. I can speculate on what it was. I'm hoping it wasn't because they got into arguments on here, either public or via PM. If you stay on this great forum long enough, you will eventually get into fights on here. We all know that I've had my fair share of them and then some. I've eaten a lot of crow for some of my mistakes.

I also have had a couple of mongers PM me and have said they thought about leaving. Fortunately, they did not.

If you have issues with other guys on here, you do have resources at your disposal. You can put the monger on ignore. This will prevent him from sending you any PMs. He also can't see your posts when he's logged in.

Another avenue is to send info via PM to members that you feel you can trust. This ensures that only your friends on here get the info. You can tell them not to forward the info to help keep it in the fold.

You have the absolute rights guaranteed under the constitution against unreasonable search and seizure. When you rent a hotel room, thats your place of residence. The police have the same restrictions as if it is your home. The property manager may just comply and give them a pass key and anything the police do with that key without a warrant is inadmissible and you have a HUGE lawsuit against the hotel and the manager involved. Same thing as in an apartment, your landlord, manager, or friend CAN NOT give the police access to your place.

The crime ADDENDUM in a lease is not a free pass for your landlord or property manager to give free entrance to the police to enter your residence, that is solely a tool to speed up and get you evicted out of the apartment. It is not a pass for the police to enter your home. It is mainly a notice that they can inspect your apartment WITH GIVEN notice or enter in an EMERGENCY as you said. It is not a release to give anyone the right to let the government enter your home.

The only basis for you RETARDED post is that if you are in a hotel, the HOTEL MANAGEMENT AND SECURITY, can enter your room to tell you to get out. During this time the POLICE MAY NOT enter. If a hotel employee sees drugs, a gun ect, and tell the police, then and only then can the police enter without a warrant.

As far as some officer saying they smell pot, I have no clue what you are referring to. If it is a car and they say as such they do have some right s to search the car. If they are outside a home and say they smell pot, that gives them the cause to GET A WARRANT and not just enter the home.
