I remember when this came out. Actually, the court ruled that the police cannot search any cell phone without a warrant. Google "supreme court cell phone search. ".

I saw it on the evening news two days ago. Just Google "can cops search cell phones" and you'll eventually find something.

The court ruled that the cops can get in your cell phone if you have to swipe it to open or if there is no code. However if you have a numerical code on your phone they can not make you give them the code and can not get in your phone. So everbody please put a numerical code on your phone so we are all protected.

An East Point woman is facing several charges for allegedly taking a Drug Enforcement Administration agent's gun and wallet from his Buckhead hotel room.

According to an Atlanta Police Department report, Dorothy McGlathery met the agent in the early morning hours Thursday. After the two went to his hotel room, the agent fell asleep. Sometime after 6:30 am, he noticed that his handgun and wallet were missing. The wallet had contained several credit cards, a debit card and cash.

DEA special agents used the hotel's surveillance cameras to obtain license plate information on McGlathery's vehicle. After running the plate, they went to her home and detained her.

McGlathery returned the agent's debit card, telling authorities that she had used it to take $40 from his account, police said. She also allegedly told agents that she had sold the handgun on a street corner for $200. She later called someone on her cell phone to obtain information regarding the gun's location, with the person on the other end of the call telling her that the gun would be in a mailbox on Tazer Road in Atlanta, according to the police report.

Authorities went to the location and found the weapon in a mailbox at an abandoned house.

Atlanta police charged McGlathery with theft by taking firearm, theft by taking, financial transaction card theft and financial transaction card fraud. She was taken to the Fulton County Jail without incident Thursday.

She was released the next day on signature bonds worth $18,000, Fulton County sheriff's spokeswoman Tracy Flanagan said.

I hope the guy wasn't one the the regulars on this forum, lots of the girls on north main carry a knife for protection from being robbed or assaulted, its a rough crowd at midnite and the girl was probably robbing him and she was bat shit crazy on some chemical. If their drug crazy, they will jump into your car and refuse to leave until you give them some money.

That's when you institute your right to bear arms! & say "hey *****. You just brought a knife to a gun fight!

Even though a recent Supreme Court ruling requires a search warrant to look at the contents of the phone as you mentioned, the phone can still be seized on the spot if there is probably cause to believe it was used during commission of a crime. As far as encrypting the information, once the warrant has been served and they are looking through your phone, if you refuse to "decode" your information, now you can be looking at an Obstruction of Justice Charge. Be smart, be safe, and I agree with your statement about seeing only reviewed and vouched providers.

Just wanted to add you can't be compelled to incriminate yourself. The government has the burden of proof. If they get your phone that isn't yours, even with a warrant, you can't be compelled to give up a password. They still have to prove that no-name prepaid phone was used to facilitate a crime, and it was yours. Best advice is the oldest advice. If you find yourself in that situation, no talking. Ask for an attorney. Getting booked and released is better than opening your mouth and making the state's case for them.
