Ahh the illusion of freedom, with things getting worse day by day I'm glad I can legally carry and I'm constantly on yellow alert for any potential situations that may jump off.

Funny you stay that, today while took a quick stroll and decided I deserved an ice cream cone after finding nothing and I stopped at a mcdonalds drive thru. Some dude comes out of the bushes all quick and tries to get into my truck until he saw me pointing my gun at his head. He then ran off back into the bushes. Its always good to be observant of your surroundings.

I send a "warning shot" - it's usually center mass. If I'm to the point where I determine it's necessary to draw and take aim. The likelihood of my taking the shot is over 90%.

The laws were designed (or added to Fl Statutes) to protect US from over-zealous liberal / communist prosecutors.

SYG was made into law. Because innocent victims were being prosecuted for lawful self-defense in their own homes. Castle Domain was always considered "common law", and typically did not require an "affirmative defense" to be a statute in order to be effective. OTOH. In North Carolina. You have a DUTY TO RETREAT. Even in your own home (which I found to be ludicrous). When the Florida legislature sought to remedy this. They extended the right to "not retreat" to OUTSIDE of your home (any place for which you had a lawful purpose for being).

Here's where the "grey area" comes in for our hobby. Say you are in the scenic Atlantic Inn. And Nikki is locked in the bathroom sucking a base pipe while her boyfriend comes through the door in a menacing fashion (purely hypothetical, of course). You are LAWFULLY in the room (because you were INVITED), but for an UNLAWFUL PURPOSE. Can you take the shot if necessary?

Under this Florida Bill you are legally allowed to protect yourself by either showing the firearm or shooting a warning shot. As long as a legit threat is there, you won't be charged. The problem is it'll go to the prosecutor and the case would be reviewed and you could be charged and then a jury could find you innocent. But whenever you blast a round and stay you'll be responsible for where ever it lands. Either way if you do or don't carry if you take it out plan on using it and eating it and articulating with your lawyer present the best way out.

Mundo that's pretty much the way it happened. He (CC person) used the gun to threaten the man and that is misdomener under FL statuate 790.10 in the state of Fla. Unless you are a LEO you can't use a firearm to threaten somebody unless your life is in jerperdy. So the idot messing with the turtles has more legal right to defend himself than the guy pulling the firearm. The idot messing with the turtles violated a bunch of different laws not but not any firearm laws.

As far as carrying a piece when mongering especially on your person I think its just inviting trouble with the law if something happens. It could be prosacuted in the taking a gun while commiting a felony / crime (even tho your not its just a misdomenor) 790.07. Now in your car with an unchambered round that is a different story cause you don't need a CCP to do that. Less trouble if its there. So even if I'm cruising to scout out the SW sceen I don't even have it in my car. Hate that feeling. So all I have is when doing that is my trusty EDC pocket legal knife it stays in my pant pocket so it can go into the room on my person and nobody know any different. As far as I'm concerned its better than nothing.

Worse case scenario - "carrying in a place of nuisance" - assuming you're actually in "a place". And that place has to be declared a place of nuisance.

While I've been a daily carrier for 25+, and would not dream of cruising the hood naked. John Law can't do / say jack. Even with a "pro" in the car. A firearm can be carried in a vehicle LOADED, as long as it is "securely encased" (glovebox / console or zippered case under a seat) without a CCW.

While it's nice to cite Fl. Statutes. A knowledgeable and TRAINED CCW holder (and florida doesn't require NEARLY ENOUGH TRAINING), knows when to hold 'them, and when to fold 'them.

Personally. Absent a weapon, I would prefer to hose someone down with the MilSpec Pepper spray I keep within reach. Lot's more fun, lot less lethal.

Too many people with CCW's have a "cavalier attitude", when armed. And wouldn't have a clue how to react in a "critical defense scenario". Hell. FBI statistics show a less than 10% hit rate in agent involved shootings. And they train even more than I do.

Mere exposure, in a threatening manner, could be considered "menacing".

When approached by someone I don't want to be approached by (typically in RaceTrac Gas Station, while pumping gas) - I tell them "whatever it is, not interested. Turn around and walk away" (with my hand up in a stop gesture). They get warned a 2nd time, verbally and hand signals if they continue to approach. The 3rd warning is the same. With my shirt pulled up and my hand visibly on my pistol. It's never gotten past stage III. And this is ALL ON CAMERA there.

The notion of some "20 foot rule" is BS. A perp, with a concealed knife or ther weapon. Can cover that 20', a lot faster than most (untrained) individuals can draw, aim and fire. So be ready to have a bead on them BEFORE they hit that 20' magic line.

I'll take the hassle of LEO during a "driving while white" traffic stop, for being legally armed (and I inform them as soon as they approach). I even had to show some rookies how to clear and lock open a 1911 one night. They appreciated the lesson.

Pull over. Open all your windows, turn your interior lights on, put both your hands on the window sill. So they can see into the vehicle and ascertain there are no threats to their safety. LEO appreciates this. They are not OUR ENEMY. They are just DOING THEIR JOB.
