Being new to this hunt I want to thank all for sharing excellent info. Started a few weeks ago with the new place in Springfield. Bella is topnotch but not hints on extras, just a little grazing the boys. Fantastic 30 min massage. She is stunning. Probably still go back.

The key word here is PATIENT. If they were a patient then you would be right. If they are simply a person (non patient) visiting the massage parlor next door then HIPAA does not apply. Now if the guy was a patient of the chiropractor, and then went next door for a massage, and they posted the photos then I agree it would be blurring the lines.

I'm with you on this one. I would not want a photo of my potential visit posted online. Unfortunately these do-gooders are messing up a good thing.

A HIPAA violation requires two basic components; an identity and a diagnosis. Whereas a photo can establish an identity, there is no diagnosis disclosed. Also there have been only about 5 significant pay outs for breaches of HIPPA. Those were done to serve as examples. I dislike what the chiropractor is doing, but they may be legally allowed to do it. There is no guarantee of privacy in a public space.

Record the person and doing this and let them know that if they post anything that implies you are doing anything innapropriate or illegal that is libel and you will be happy to own a chiropractors assets.
