I have been wanting to post about this case since it first came out but until now never had the time. It is a landmark case for those mongers whose vehicles are impounded from picking up streetwalkers and subjected to civil forfeiture. In Timbs, the State of Indiana confiscated his Land Rover, worth over $40,000. 00, after a drug sting. His fine was $10,000. 00, only one fourth the value of his vehicle. He alleged the excessive fine clause of the Eighth Amendment violated his constitutional rights. The Indiana Supreme Court held the the excessive fine clause did not apply to the States, but only to the Federal Government. The United States Supreme Court, under Justice Ruth Bader Ginsburg and a unanimous Court, held otherwise and that the 14th Amendment made the prohibition of excessive fines applicable to the States. The Bill of Rights, the first 10 amendments, only apply to the Federal Government, not the States. However, the 14th Amendment makes the Bill of Rights apply to the States for all citizens. The 14th Amendment also goes on to define who is a citizen, just in case there is confusion. You remember the 14th Amendment don't you? That's the Amendment that Trump says he can abolish just by executive order. The 14th Amendment is pretty fucking important, especially if you are a gun enthusiast like myself. Without the 14th Amendment, although the Federal Government could not confiscate your guns, the states certainly could. So us gun enthusiasts can thank that the 14th Amendment and the Supreme Court case of McDonald v. City of Chicago that the 2nd Amendment also applies to the States. Justice Ginsburg held that a civil forfeiture of a $40,000 vehicle when the actual fine was only $10,000 violated the 8th Amendment. She effectively held that civil forfeiture of in itself violates the 8th Amendment. Therefore, civil forfeiture will no longer be available. This will not only assist mongers in getting their vehicles back, it will also allow mongers to bring what is known as a 1983 suit against the City and the police for violating their constitutional rights. Under 1983 suits, you can collect a wide variety of damages, including punitive damages against the individual policement, but not the City. What you have to show is that the individual policeman intended to violate your rights. Since he intended to confiscate your velicle, this would be easy to show. Lets say you have a vehicle worth $20,000 and it is impounded because you tried to pick up a SW. The Supreme Court has held that punitive damages are limited to 10 times your actual damages. This means you would be entitled to $200,000. 00 in punitive damages, in addition to any other damages, which the officer is personally liable for. Punitive damages cannot be discharged in bankruptcy. I suspect that this will give an office pause before impounding your vehicle. So you mongers have Ruth Bader Ginsburg's wrinkly old ass to thank for saving your ass.

I've seen extremely negative reviews on her. I wanted to pull the trigger on her so started my research on her. The verdict was that you will be rushed and not get the best service. When I did talk with her she was gung ho to meet me until she found out that I'm a reviewer. My thoughts on that, considering how much she advertises I would think that she would welcome exposure, but she shut down down. That's open to interpretation, but it made me leary.
