Many police officers are single, and therefore candidates for mongering. Hence, the cops won't prosecute anybody unless forced to. DAs on-the other hand are a different story.

Cops do what city hall says to do, and city hall does what calls to council members creates. Political pressure.

What cops do is prioritized by the politics of whose picking up the phone to complain.

Cities don't even have highly lucrative traffic patrols anymore due to staffing and load, you could walk in and out of a known rub & tug with a cop sitting there, and they would be unlikely to do anything but laugh while 5 deep in the queue on screaming neighbor complaint calls to manage.

They could surely try to prosecute, but outside of actually admitting guilt ourselves they wouldn't have a chance in hell of actually getting a conviction. And knowing that themselves they know its not even worth the time trying.

It's good to be paranoid and all, but I don't think cops are that motivated to prosecute. The first time you are caught, you can take a one-day class costing approx $700, and other things might be added such as community service depending on county. Second time you are caught, it's a misdemeanor charge with some jail time. I think 45-days to 6 months, and maybe lawyer can plead and reduce the sentence. Also, I don't know how they're going to convict unless there's an audio recording that you're explicitly paying for sex. Lawyer can pretty much argue anything and maybe use the lack of info to get you probation instead of jail.

Overall this is not a big enough catch for them to put in all that effort of stalking you and keeping tabs. It's either you are caught or not at all. Now, if we're talking trafficking, they're more motivated since it generates better headlines. If we're talking child trafficking, they'll be all over that shit.

They could try under "manifestation with the intent to commit", just depends on how eager they are to prosecute. You don't walk into a Mc Donalds without the intent to buy food or a drink. So they could make the argument that you are intending to commit the crime. Needless to say, they could still make your life living hell if they want.

Now would they, probably not.

I mean that depends on what you have said over the phone to them, as far as PD would ever be concerned with me and most mongers, I asked for a certain girl and was told that the charge would be x amount per hour, no mention of what that hour was for or what we would be doing or did, and just having my info wouldn't prove anything. What happens if an org gets booked? Won't LE have access to all our phone numbers?

Thats why you use a burner phone for all activities. Could they track you down with a burner? Sure, would they bother for a misdemeanor? Probably not, but you never know.
