And since the case will be heard in San Francisco, a famously liberal jurisdiction, the defense attorney will only need to convince one juror that providing an advertising / discussion site for adult pursuits has absolutely no equivalence to pimping or trafficking or otherwise profiting from illegal activity. If the govt loses this case, it will be a major victory for free speech and individual freedoms.
Better yet just legalize the whole damn thing, switch LE's focus to stopping real (not imagined) trafficking and violence against women, and thereby join most of the civilized world!

I'm not a legal beagle so I might be talking out of my ass.
Two major differences between us and Redbook.
1. Our revenue from here is only from banner ads. We are working on some other sites that will be affiliates, but the USASG doesn't take any money from chicks posting ads.
2. Neither us, nor our servers are in the USA. I don't think the Redbook guys did that. This week they would have to find the data in Liberia, who knows where the servers will be next week.
The only thing we really need to do next is to move the URL which we might get around to someday. As of right now, this is a discussion forum and nothing else. So far, they haven't written out protected speech in the constitution. Given the way things are going in Sex Prison, I'm not sure it's always going to be that way but for now you guys can continue to publish your fiction and thought exercises as long as you wish.
Again, I'm not a lawyer, have never played one on TV, nor did I stay in a Holiday Inn Express last night. I'm pretty sure I'm correct about this but I'm not positive. We are thinking about starting some social media, not really for the conversation, just to have multiple places you guys can find us if we ever need to move quickly. Maybe Twitter and FB. Again, not so much for the convo, we wont be pissed if nobody likes us, just a place we can post a new link if need be.

When you read it, you'll notice that everything hinges on the first count, which says that the RB owners used interstate commerce (the internet) to promote activity that is unlawful in various states, including CA's penal code section 647 be. All the remaining counts are either money laundering or forfeiture charges that rest entirely on whether or not Count One is found to be true.
Like BP and Craigslist, RB's defense will most likely center on the fact that the owners were simply providing a forum for advertising and discussion and had no direct involvement in any illegal activity. I don't know about statutes in other states, but CA 647 be is a misdemeanor and is what's called a "specific intent" statute (http://law.onecle.com/california/penal/647.html) which should provide a pretty decent platform for a good defense lawyer. One problem may be if the govt has already frozen the accounts of the owners, thereby depriving them of the resources they'll need to fight what, IMHO, is a clear govt overreach.
What I think is significant is, if the govt succeeds in this case, they could conceivably use the very same arguments against BP, CL, TER, Eros, USASG and others. And if the govt effectively shuts down or inhibits the hobby's use of the internet, then the oldest profession will just move back onto the streets or adapt in other ways. And that will probably mean additional risks for both provider and client.
Any legal beagles (professional or amateur) care to weigh in?

Not a good look at all for the DMV p4 p scene when you consider the massive number of providers from out West that routinely post ads in this area. This is so typical of how BS morality-based politics can make life harder for everyday people for no GD reason! Now mongers & providers are deprived of a wealth of information that made this game much, much safer.
Our gov't at it worst.

Sex is human nature. Some people have higher sex drives then others and need more than from their wife or g / f but may not want or have the time for another relationship. Others may have fantasies or fetishes or may even lack social skills to have relationships with the type of woman they are attracted to. Their just going to drive things to be more of an underground network. Next thing will be Johns and providers being in a black book. Once you have had sex you get a rating and you get in and your in your good to go.

If she is LEO, or working with LEO, then the odds are you are being recorded in some way and hanging around even for a few minutes more could give them enough justification for an arrest. There are plenty of other options out there and it's not worth the risk, IMHO.

No system is perfect, but the more risk that can be removed, the better.
