This isn't child custody, this is a divorce, the judge won't say she's not entitled to anything because of morals (Please refer to sentence A).

    5) Saying she did / does drugs doesn't mean squat, especially when the husband known and even helped her get the stuff, again morals / different court. (Please refer to sentence A).

    6) If he cheated on her with hookers hes the one who operated in bad faith, under normal circumstances the guy would be screwed during a divorce, but its even worse if she was operating in good faith in the marriage while the guy wasn't. Even though they weren't married long, if she can prove his infidelity, the court will see it as "She would have stayed married longer had you been faithful, this is not just a gold digger looking to cash out.

    Bottom line, know the Law for your state and situation.

    Yes, Florida is a no-fault state but each divorce has its own circumstances and uniqueness. However, the "FAULT" whatever it may be can affect Alimony and custody decisions in some cases. Someone mentioned 10 years and 50 %, I always SMH when I hear this. What I am talking about deals with military retirement pay.

    Two misnomers with the division of military retirement pay is:

    1. You must be married at least 10 years.

    2. She gets half your pay.

    The 10-year rule is used to determine who pays the spouse. If married less than 10 years the spouse is not entitled to receive alimony directly from the military. Less than 10 years but qualified for alimony the retiring member would pay the alimony directly and / or as set up by the Court. Married 10 years or more the military Defense Financing and Accounting Service pays the alimony directly to the spouse from the member's retirement.

    Fifty percent (50%) the law simply states, she / he can be awarded up to 50%. In a military member case, that percentage is determined by a calculation. Again, speaking only of my situation. Although my divorce did not end many years pass 10 years, my lawyer ended the marriage when we stopped being physically involved (sex). It made a huge difference in the outcome and I don't miss it.

    I learned a lot about the divorce court system, I got burnt by not following an order to the letter. I then used their own logic to win a decision. My lawyer did not want to bring the matter before the judge but I requested a hearing and the judge agreed with me. It was a simple matter of what the Order said and did not say and my ex's lawyer wanted me to pay something that was NOT clearly defined in the order.

    It is pointless to argue the Monger vs. BP Girl case when we do not know every circumstance.

    It used to be that you had to be married at least 10 years in Florida to get anything. Also, she would have had to been in a certain lifestyle for a period of time- which she was not. I think the husband should be fine. No alimony for you Felicia!

    They were married for less than a year (not sure but you only get half of what the other made while you were married?     Coming out of retirement to go into retirement
