Unfortunately for your friend, she doesn't get to start over with the appeal. Trial Court Errors, with very limited exceptions, must be objected to at trial or they are waived. against the
Her only reason for appeal would be a claim that the conviction was against the manifest weight of the evidence. Ac standard she can't win since the trial court's determination of the facts is given great deference on appeal.
If she had an attorney at trial, she could quite possibly have prevailed, but that horse has left the barn.
Remember the two most important ups when dealing with the police.
1. Shut UP
2. Lawyer UP
If she didn't have a lawyer, she didn't have adequate representation in the eyes of the law - she should have grounds for an appeal based on that.
But, if the fine was minimal, it's over and done with, and a fine was all she got, is it really worth it? Seems like a thing to just move on from to me.
All we know is a streetwalker interacted with an under-cover cop. Nothing about P4P has been mentioned thus far. All talk about there being no audio tape or money changing hands, and failings of the judicial system may be true, but it misses the point. If she agreed to do the deed, P4P, they have her. If not, they don't.
Here is the deal as told to me via PM's.:
The Police were suppose to keep the Money given as evidence, and since that never happened, via her word they had none. Each time LE does a sting all evidence is kept no matter what it is. Then LE always tape the whole event, mainly video, but due to the situation the audio portion of that is the nailer.
LE had none of this, and this was a Sting Team. One of the officers even tried to arrest her, but the one of the other officers even told them they had no evidence thus they settled on a ticket. The officer who tried to arrest her wanted something out of it, thus a ticket.
She had no money for a lawyer, and the case did not raise to the level of getting a Public Defender. Basically she was Doomed in the courts of Hamilton County.
Even a Half Ass attorney would have been able to get her off, but again MONEY is the problem. The court are about Money, Not about Justice. With a decent attorney it would have been thrown out, never making it to court.
As for the speeding ticket, not court will let an officer give you a ticket for speeding with evidence and logging that evidence. This includes log records, instrument mastering & verification, location, and the law itself.
This I know because I have beaten many Speeding tickets, in several Counties, especially Hamilton County.
This was done without an attorney, against a Prosecuting Attorney.
So the thing about the steering wheel is really a little far out there, but I can appreciate what you were trying to say.
Basically she got the Shaft, and the Police, Prosecutor, and Judge knew this. This is why she got the lowest fine possible, instead of the highest, which could range up to $1000.
As for the Attorney that PMed me I will turn your name over to her, but I think now she just wants to just pay off the fine. I think she should fight it for future purposes, but the Court System is made to just beat you down. She has been beat down, and she again lacks money. Good thing she is not on Drugs.
However, where there is no incarceration at risk, a person is not entitled to representation. In those cases, where a person elects to represents herself, you own your own screw ups.
In reality your asking a three judge panel to give you a new trial because you didn't know what you were doing and didn't hire an attorney. Pay the finbe and move on.

Something weird about the picture though, she doesn't quite "feel" like an escort does she? That looks like a facebook picture of some college girl to me. Just saying.

You're always entitled to Representation. But, like I said, sounds like something just to put behind her, and keep moving to me too.

Hello All,
I just wanted to take a moment to pass along my sincere gratitude to Harpo for all of the assistance he gave me back when I was a newbie to this board. He never treated me like I was a distraction to him. He was always there with a word of encouragement and accurate referrals for me. Harpo I do thank you and wish I could have given back to you all of the help you gave me. I know that we tend to hobby at different levels but you will always have access to any information at my disposal and if there ever is a need in the future for my support you have it. Just ask.
Since joining this board I have made many close friends and I value them all immensely. You guys already have most of my information so I know you are being kept happy LOL! You also know that you too have my support if needed. You all know who you are and I want you to know that the first round is on me this week. Just be easy on me and stay away from the top self drinks LOL! I do need to visit a lady or two this week LOL!
Even though I will never be able to provide Harpo the kind of assistance that he gave me I have tried to provide the same assistance he gave me to new members here on the board. I do hope that I have been a help to at least some of them.
If we all try and pass along a little of our experience to the new guys I think the board will be a much better place to call monger home.
Again, thanks to all my friends here and a special thanks to Harpo for helping me get started. Sorry if this sounded a little mushy but I do believe that some of the long time Senior members do not get the credit they deserve for making this a great place to meet and interact.
Sincerely,
KG
Harpo was one of the 1st to help me also when I was a newbee. Without his help I probly would still be lost. Ty harpo

Agree that Harpo's willingness to help newbies and seniors is great. I looked back at early PMs and he was always sharing his experience, even with guys that had single digit post counts. Thanks.
Have a great day.

Ditto this. I remember late last Spring when I first met Harpo and Whodeyman over dinner and drinks. Comic Whodey put in reservations for three under the name "mongers". The hostess wanted to "escort" us to the table - you can imagine the evening from there!
We all learned invaluable insight from him as nubies. Thanks again Harpo. Damn, this all sounds like cudoes to an obit! Harpo, surface again sometime!!

Police lie in court all the time. I can almost understand why they do. It ain't always about Justice & Money, but that is a Big Factor, but in order to create an arrest and it makes it to court, it is really in your favor not the Justice System, because it they don't Dot the "I" or cross the "t's", the whole case can be thrown out, police & prosecutor man hours are lost, and Tax Money is lost & wasted.
So cops will Lie their Asses off, and the Judges and prosecutors know this. This is why a decent lawyer is of value, but it cost money and that is why the jails are full of people who are poor. Too poor to afford an attorney.
Most of these crimes don't involve jail time, but jail time comes into play because they either don't show up for court, or never pay the fine.
So if this girl only got a fine, then consider herself lucky. Many times the Police set up SW's so they will do time in the JC, because they need the numbers for the coming new jail, so Uncle Simon can retire.
Even the MOST Honest Cop will lie about things in court because screwing up a court cases could be very bad on his yearly evaluations, and possible future promotions.
So know you better go into court OVERLY PREPARED, and always be prepared for the Worse. Buy yourself an ORC, and keep abreast of the Law, and know your Rights & Privileges.
Say nothing if stopped and totally silent if arrested, and obey the cops as best you can.
Being Polite & Well Mannered, can go a long way, and avoid a ticket or an arrest.
