Thread related to Ohio Law and classifications.

I am very curious to know or learn information regarding the classification of "Loitering to Engage". I have seen this several times on county sites for individuals involved in hobbies; with this classification associated. I have attempted to search for information on this and regarding to this.

Something that I have found related to this classification of "Loitering to engage in solicitation" is terminology about "after positive HIV test".

What I am curious of, is, if an arrest is made and individual has above associated with their arrest, does this mean they are Positive for HIV, or is this pending a test, etc? Does anyone have any information related to this or can expound on this in any way, shape, or form.

I have noticed this classification on a few of the individuals in the local area recently; and I'm quite surprised at how many are associated with this classification, vs. Solicitation.

Any info would be greatly appreciated and would increase my knowledge base.

2907. 24 Soliciting. After positive HIV test. Driver's license suspension.

(A) No person shall solicit another to engage with such other person in sexual activity for hire.

(B) No person, with knowledge that the person has tested positive as a carrier of a virus that causes acquired immunodeficiency syndrome, shall engage in conduct in violation of division (A) of this section.

(C) 1) Whoever violates division (A) of this section is guilty of soliciting, a misdemeanor of the third degree.

(2) Whoever violates division (B) of this section is guilty of engaging in solicitation after a positive HIV test. If the offender commits the violation prior to July 1, 1996, engaging in solicitation after a positive HIV test is a felony of the second degree. If the offender commits the violation on or after July 1, 1996, engaging in solicitation after a positive HIV test is a felony of the third degree.

(D) If a person is convicted of or pleads guilty to a violation of any provision of this section, an attempt to commit a violation of any provision of this section, or a violation of or an attempt to commit a violation of a municipal ordinance that is substantially equivalent to any provision of this section and if the person, in committing or attempting to commit the violation, was in, was on, or used a motor vehicle, the court, in addition to or independent of all other penalties imposed for the violation, shall impose upon the offender a class six suspension of the person's driver's license, commercial driver's license, temporary instruction permit, probationary license, or nonresident operating privilege from the range specified in division (A) 6) of section 4510. 02 of the Revised Code.

2907. 241 Loitering to engage in solicitation. Solicitation after positive HIV test.

(A) No person, with purpose to solicit another to engage in sexual activity for hire and while in or near a public place, shall do any of the following:

(1) Beckon to, stop, or attempt to stop another;

(2) Engage or attempt to engage another in conversation;

(3) Stop or attempt to stop the operator of a vehicle or approach a stationary vehicle;

(4) If the offender is the operator of or a passenger in a vehicle, stop, attempt to stop, beckon to, attempt to beckon to, or entice another to approach or enter the vehicle of which the offender is the operator or in which the offender is the passenger;

(5) Interfere with the free passage of another.

(B) No person, with knowledge that the person has tested positive as a carrier of a virus that causes acquired immunodeficiency syndrome, shall engage in conduct in violation of division (A) of this section.

(C) As used in this section:

(1) 'Vehicle' has the same meaning as in section 4501. 01 of the Revised Code.

(2) 'Public place' means any of the following:

(a) A street, road, highway, thoroughfare, bikeway, walkway, sidewalk, bridge, alley, alleyway, plaza, park, driveway, parking lot, or transportation facility;

(be) A doorway or entrance way to a building that fronts on a place described in division (C) 2) a) of this section;

(see) A place not described in division (C) 2) a) or (be) of this section that is open to the public.

(D) 1) Whoever violates division (A) of this section is guilty of loitering to engage in solicitation, a misdemeanor of the third degree.

(2) Whoever violates division (B) of this section is guilty of loitering to engage in solicitation after a positive HIV test. If the offender commits the violation prior to July 1, 1996, loitering to engage in solicitation after a positive HIV test is a felony of the fourth degree. If the offender commits the violation on or after July 1, 1996, loitering to engage in solicitation after a positive HIV test is a felony of the fifth degree.

It pretty much takes und / cov operation to make such a bust and they usually only do so when one of these operations raises its personna way above UTR. Then unwanted attention seems to follow.

Any engagement that one makes to exchange a sex act for money is illegal in OH, and most other states. This includes a little extra friction at the end of a full body massage.

LE usually picks low hanging fruit and as a general rule there are much more flagrant operations that are easier to prove the chgs.

But, that doesn't mean that one cannot be arrested for offering or accepting money for a HE involved with a massage in OH. It happens, but it is truly a matter of logistics, the available manpower for such things, versus more dangerous crimes on the street. But certainly best the less that is said and written about such operations.

The genitalia are never supposed to be exposed at any time. One way to determine if there might be a little more available is to not cover up with the sheet. I hate to be the bearer of bad news, but vice can do anything they want and they have. I have read articles and talked to other providers where the undercover has gone all the way, and then arrest them. It happens, and there is no such thing as a cop check to verify that they are real either.True, what you have to keep in mind is cops lie, cheat, steal, everyday. So if they want they will. By law their not allowed to do a lot of things but they will anyway and most of the time they get away with it.

You are lucky. I know a few unlucky ladies from USA Ad were booked recently.
Like you ladies moved from BP to USA, I think LE has shifted their attention to USA too.

There are several methods but you know them all I guess.
One way is you NEVER mention money. I know a smart girl who never mentioned money any point. Even after we were done, she still didn't say a thing. I was impressed. In that way technically cops can't charge a solicitation (of course they would lie if they want but).


I think I got a cop yesterday. When he offered triple what I wanted the flags started flying! I came really close to getting in trouble. Any suggestions on how to spot a. Cop.

AWhen someone is arrested for solicitation they go to jail and go through the court process. Once they are sentenced before they are released they are court ordered to be tested for HIV before release. If the person's test comes back positive that person is contacted and has to register with the health department.

Specifically, when a previously convicted prostitute is again charged with prostitution, is her name checked against the list to determine if the charge should be a felony? I do know if that person is seen in the high risk ares for streetwalkers or advertising first their name will be ran and I know an alert will come up that she has HIV / AIDS and she will be arrested information solicitation with HIV once booked in the higher ups will determine what to charge her with. I know of one girl that frequents the East and she is arrested weekly and she is a known carrier, however she hasn't been to the big house yet. Anyway, everyone be safe.
