Can a man or woman be charged with prostitution related charges based only on statements made by either one? In other words, do the police have to witness the exchange of money to file charges?

If a woman admits to police that she accepted money in exchange for sex, can file charges against the man who gave her the money?

If a man pays bills for a woman and she had sex with him, can either of them be charged on prostitution related charges?

So on that alone don't say anything. Invoke your 5th ammendment rights and do not lie to police. If you haven't jackpotted yourslef with self-incriminatory statements then it's just the word of a junkie prostitute against yours. You win.

In other words, do the police have to witness the exchange of money to file charges?Can they be charged based on that? Yes. Will they be convicted based on that? Probably not, although it depends on the circumstances. A LEO saying a guy propositioned her would be taken much more seriously than a random SW. But in most cases, LE need more evidence than just one person's word to get a conviction. They don't necessarily need to see money change hands, just so long as there is a clear agreement of money for sex.

Depending on which state this is in, they might also do a polygraph test see if one of them shows up as deceptive. Realistically though, they'd probably just ignore the guy and arrest the woman. It wouldn't be worth the hassle just to get a misdemeanor solicitation charge.

The woman is still exchanging sex for financial benefit, even if she's not the one receiving the money.

I should point out that none of this is legal advice. It's simply my views on the questions.
